All Inkblocks™ and Inkbits™ (herein after referred to as “Inkbloom™ Designs”) are copyright of Inkbloom™ and are protected by the United States and International Copyright Law. All Inkbloom™ Designs are owned by Inkbloom™ and licensed to the original purchaser ONLY. Purchasing Inkbloom™ Designs does not give you ownership rights to its content. It simply means that you are granted permission to use Inkbloom™ Designs royalty-free for purposes of personal and/or limited commercial use as outlined in the Usage Guidelines and Licenses below.
A. Permitted Uses & Licenses
1. Personal Use - Standard License: By purchasing Inkbloom™ Designs for personal use, Inkbloom™ grants you a personal, non-exclusive, non-transferable Standard License. Personal use is non-commercial use, and is defined by expressly prohibiting any direct or indirect monetary benefit as a result from the use of Inkbloom™ Designs. You may use them freely on items you create for yourself or as gifts to others. You are permitted to use third-party vendors and/or custom printing services to produce items for personal use only provided that you do not allow these vendors and/or services to make your items available for others to purchase.
2. Limited Commercial Use - Expanded License: By purchasing Inkbloom™ Designs for limited commercial use, Inkbloom™ grants you a non-exclusive, non transferable Expanded License. Limited commercial use of Inkbloom™ Designs is defined by direct or indirect monetary benefit as a result from the use of Inkbloom™ Designs in any way. Examples of limited commercial use include, but are not limited to:
[a] Hand-made merchandise created with fabric using Inkbloom™ Designs such as purses, bags, pouches, totes, wallets, fabric tags, place mats, napkins, sachets, or similar items that you intend to sell directly to the public.
[b] Hand-made merchandise created with paper and/or Loomtack™ using Inkbloom™ Designs such as greeting cards, invitations, note pads, stationery, gift tags, wrapping paper, stickers, labels, calendars, scrapbooks or scrapbook pages, or similar items that you intend to sell directly to the public.
[c] Incorporated in the design of personal and/or corporate identity collateral such as stationery, business cards, postcards, flyers, posters, brochures, sell sheets, point of sale materials, packaging, catalogues, calendars, print or digital newsletters, print or digital editorials, websites, digital banners, e-cards, catalogues, or similar items provided that the use of Inkbloom™ Designs is not in violation of section B.1. below.
B. Prohibited Uses
Listed below are prohibited under any circumstance. Inkbloom™ Designs, in whole or in part, MAY NOT be used in or for the following purposes:
1. Physical Merchandise: Any form of physical merchandise to be commercially manufactured, produced, sold and/or distributed domestically or internationally.
2. Digital/Electronic Merchandise and/or Media: Any form of digital/electronic merchandise and/or media for resale or redistribution, in its original form or superficially altered states, including, but not limited to, templates for digital photography, digital scrapbooking and/or other craft-related industries, digital tools such as graphic brushes, layer styles, textures and actions, templates for flash websites and blogs, wallpapers and screensavers, e-cards, digital banners, or similar.
3. Corporate Identity: Any design for a business logo where Inkbloom™ Designs represent more than 50% of the logo or business identity.
These guidelines and licenses may be updated from time to time to include relevant new and future usage/applications. This agreement is retrospective and supersedes any previous versions or modifications.
